Terms of Use

This agreement is between you and Chris Armytage Photographic Art and your use of this website indicates acceptance of this agreement.

Our products and services are only available to, and may only be used by, individuals who can form legally binding contracts and are not available to persons under 18 years of age.



We may amend the terms of this agreement from time to time, and we will let you know about these changes by displaying information about the changes on our web site. Your continuing use of the Chris Armytage web site will be taken to be acceptance of the new terms.

Products and Services


Chris Armytage Photographic Art provides a range of services including but not limited to, enabling you to purchase art or digital content. If you place an order for art, Chris Armytage Photographic Art will arrange to have the art manufactured and the physical product delivered to you in the form specified by you at the address provided by you. Digital content may be software, information, text, data, graphics, images, photographs, sound, video, music or any other material either wholly owned by Chris Armytage Photographic Art or available in the public domain.


You can purchase art or digital content from our website using the PayPal system. We do not have facilities to process credit cards and requests to pay directly by credit card will be denied. The price you pay is clearly shown on the website and is fixed at the time of ordering. Your order, once submitted, is irrevocable and may not be cancelled.

If you order products which need to be delivered to you by mail or courier, it is your responsibility to ensure the product delivery address is correct. Chris Armytage Photographic Art takes no responsibility for any product you do not receive because of errors in the delivery address you provided to us.


Cancellation

You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information or may be unavailable. This may be due to an error or similar oversight. We reserve the right to cancel an order in that event.

We may also cancel an order if we believe that it is being made in contravention of any applicable law or if we believe that it may be fraudulent in nature.

We may cancel an order even if it has been confirmed and the customer’s PayPal account has been charged. We reserve this right up until the time of delivery of the product to that customer. If a cancellation of this nature occurs after the customer has been charged for the product, we will immediately credit the customer’s PayPal account for the amount in question.

Delivery


Delivery will be made by postal or courier service and will be paid for by the customer at the price indicated at time of purchase.

Damaged Goods


If you order digital content and that content is damaged when it is received by you, Chris Armytage Photographic Art will permit you to download that content again. If you order product that requires delivery to you by mail or courier, and the product is physically damaged in some way then Chris Armytage Photographic Art will issue a replacement copy of the product. It is the customer's responsibility to notify Chris Armytage Photgraphic Art within 14 days of receiving the product to advise us of the nature of the damage and to arrange for a new product to be sent. This policy applies only to actual physical damage to the product and not to any content.

You must ensure that your access to this web site is not illegal in your jurisdiction.

You must take your own precautions to ensure that, in accessing this web site, you are not exposed to the risk of viruses, malicious computer code or other forms of interference which may damage your computer system. IN NO EVENT SHALL CHRIS ARMYTAGE PHOTOGRAPHIC ART BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT DAMAGES, OR FOR ACTS OF NEGLIGENCE THAT ARE NOT INTENTIONAL OR RECKLESS IN NATURE, REGARDLESS OF WHETHER IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree that our total liability hereunder for damages, regardless of the form of action, shall not exceed the total amount paid for products or services.

Chris Armytage Photographic Art shall not be liable for any failure or delay cause by events beyond our control, including, without limitation, your failure to furnish necessary information, your failure to make a valid PayPal payment for goods and or services ordered, failures or delays in transportation or communication, failures or substitutions of external suppliers, accidents, labour disputes, shortages of labour, fuel, raw materials or equipment or technical failures.

Jurisdiction

This agreement is governed by the laws of the State of Victoria and the Commonwealth of Australia.
